Minutes
October 19, 2006, 7:00 P.M.

1.0     Preliminaries
1.1     Paul Byrne opened the meeting at 7:00 PM.
1.2     Roll Call:  Chairman Paul Byrne, Vice-Chairman Minot Wood, David Esteves, Terrence Joyce, Misty-Anne Marold and Joe Rodrigues.  Conservation Agent Katrina Proctor was also present.

2.2.1   MACC $361.00 Byrne made a motion to approve the voucher, seconded by Marold with all in favor.

3.0     Correspondence
3.1     Rec’d copy of Request for Superseding Determination – Carroll, 7 John Robinson Dr.
The letter submitted with the Request was reviewed by the Commission.  Joyce strongly suggested the Commission draft a letter to DEP clarifying the facts know to the commission and opposing statements made by the Carroll’s.
3.2     Rizzo Associates – Notice that Phase IV Final Inspection Report and Completion Statement – 12 Wheeler Rd. is on file with DEP. – NOTED.
3.3     Lycott Environmental – Report on Lake Boone aquatic vegetation. – Copies were provided to the Commission for review.
3.4     Colonial Dodge – Release Mediation Plan – Noted.
3.5     Rizzo – Release Mediation Plan – Noted.

4.0     Vote/Issue Permits – None.
5.0     Conservation Agent Report
5.1     Lauren Heights – Proctor informed the Commission that she emailed David Burke wetlands consultant for Mike O’Malley stating that the Commission has waiting for a report or NOI for the damage to wetlands on the Louriero property.  The Commission said that if we do not hear back by Monday we will contact O’Malley about stop work under the Enforcement Order.

Continue to Continuance Hearing Notice of Intent (DEP 190-483)
                Applicant:  Richard Wiel
        Location:  6 Lakeside Ave.
Project Description:  construction of a replacement septic system and associated piping & structures.

Byrne made a motion to continue the hearing to Nov. 2, seconded by Wood with all in favor.

        Applicant:  Richard Wiel
        Location:  8 Lakeside Ave.

Byrne made a motion to continue the hearing to Nov. 2, seconded by Wood with all in favor.

Continuance Request for Determination of Applicability (HUD #331)
        Applicant:  George Contrada
        Location:    123 Main St. (Hudson Motor Cars)
Project Description:  replace water supply pipe between street valve and meter, install granite planter to enhance walkway project, grade and repave parking lot as needed.

Byrne made a motion to continue the hearing to Nov. 2, seconded by Wood with all in favor.

8.4     Request for Determination of Applicability (HUD #330)
Applicant:  Edwin James Kroeker
Location:    4 Hickory Lane
Project Description:  Grading to make the rear of the residential lot more useable.

Mr. Kroeker stated that he would like to withdraw his request to grade the property.  He said he would like to learn more about natural vegetation.

Byrne made a motion to accept request to withdraw the application, seconded by Rodrigues with all in favor.

8.5 Continuance Hearing Notice of Intent (DEP 190-0478)
        Applicant:  Hudson Public Schools
        Location:   69 Brigham St.
        Project Description:  construct a single story storage shed behind the existing High School.

The habitat evaluation was submitted 2 weeks ago.  The Commission has had the opportunity to review it.

Byrnes made a motion to close the public hearing and issue a standard order of conditions, seconded by Rodrigues.

There was discussion on the motion.  Misty-Anne Marold recommended the following special condition.
1.  For any construction during the month of June, a silt fence must installed around the entire building and only allowed to be opened during the day when the work is ongoing and closed each night at the close of the work day or if it is preferred not to use silt fence, no heavy equipment is allowed during the month of June.

Byrnes made a motion to close the public hearing and issue a standard order of conditions plus the special condition, seconded by Rodrigues with all in favor.

        8.6  Continuance Hearing Notice of Intent (DEP #190-486)
Applicant:  Paul Davis
Location:  Chapin Rd.
Project Description:  the owner/applicant proposes to construct a home with grading, driveway, culver installation over intermittent stream and landscaping.

Byrne made a motion to continue the hearing to Nov. 2, seconded by Wood with all in favor.

        8.7 Continuance Hearing ANRAD (DEP #190-485)
        Applicant:  LPM Holding Company, Inc.
        Owner:       Watson Ventures LLC
        Project Description:  resource area delineation only

Stacy Carpenter, Hancock Associates submitted a revised plan “Wetland Location Plan, EC dated 7/26/06 rev. 10/19/06 and a plan dated July 1916 showing a mill and other buildings on the property.  In addition, the definition of Historic Mill Complex was provided and discussed.
It was noted that this hearing has been continued several times awaiting an opinion from DEP regarding whether Riverfront is associated with this project.   Marold said she spoke with Gary Dulmaine the DEP analyst on this application and he agreed to submit an opinion.  Carpenter noted that per the Commission’s request, she also has tried to get an opinion from DEP. Both Marold and Carpenter agreed to contact Dulmaine again requesting his opinion.  The Commission and Carpenter will keep in touch and will notify each other upon receipt of such letter.  The hearing will continue after receipt of the letter.

Carpenter explained that she believes there was a sluiceway located within the Assabet River; however, it would require a dredging permit to uncover the structure.

Byrne made a motion to continue the hearing to 11/2/06 or after the DEP letter is received, seconded by Rodrigues with all in favor.

9.0     Commentary
9.1     Budget Reviews Tuesday November 14th at 1:00 PM
9.2     Budget Hearing Tuesday, January 9th at 8:00 PM

10.0    Adjournment – Byrne made a motion to adjourn the meeting at 8:00 PM, seconded by Rodrigues with all in favor.
